Homecare Agency will comply with all Federal, State and local laws and regulations and will report all compliance issues. The organization also complies with accepted professional standards and practices. Negative outcomes effecting accreditation, regulatory compliance, or licensure are documented and reported to the governing board and ACHC by the Homecare Agency.

 

 

1)      The Homecare Agency will demonstrate compliance with all laws and regulations such as local and state, licensure, professional licensure/certification, practice standards, the Americans with Disabilities Act, Equal Employment Opportunities Act, Fair Labor Standards Act, Title VI of the Civil Rights Act of 1964, Occupational Safety and Health Standards, CMS/Medicare regulations, Medicaid regulations, Omnibus Budget Reconciliation Act 1987, Balanced Budget Act of 1997, occupational licensure laws, Public Health regulations relating to infectious diseases, HIPAA regulations and other laws and regulations as applicable to the service/care provided by the organization.

 

2)      The Homecare Agency will comply with Civil Rights and Equal Employment Opportunity Acts as required for organizations receiving State or Federal funds (Medicare, Medicaid, Title III, Title XX, etc.). 

 

3)      The Homecare Agency will comply with OSHA, FDA, DEA, Dept. of Transportation, State Dept. of Agriculture, all appropriate occupational licensing boards, and all required business licenses for city, county, and state are required for all organizations as applicable to the service/care provided.

 

4)      Accepted standards of practice and occupational licensure acts are utilized by the organization to guide the provision of service/care.

 

5)      Copies of all required federal and state posters are placed in a prominent location for easy viewing by staff.

 

6)      The Homecare Agency must disclose information regarding ownership and management and any changes thereof.
