 Leave of Absence 
SUBJECT:       LEAVE OF ABSENCE
 
 
PURPOSE: To balance the demands of providing excellent services at the workplace with personal life and commitment, Medical Staffing Solutions (Company) will provide an unpaid leave of absence to eligible employees for certain personal reasons. The provisions of this policy do not apply to leave under Family Medical Leave (FMLA) Policy.
 
A Corporate Officer may approve an employee's request for a leave under this policy for the following:
 
Type of Leave
Length
            1)         Personal leave not related to FMLA
12 Weeks
            2)         Education
12 Weeks
            3)         Military service or reserve training subject to applicable Federal and State laws
as provided by law
 
All employees are eligible for Leave of Absence under this policy. As an initial step in the leave of absence process, the employee is required to submit a written request to a Corporate Officer. Each personal and education leave will be considered on its own merit.
 
The total leave time cannot extend beyond 12 weeks unless an extension is approved or provided by law.
 
Notification Requirements
An employee must notify Company of her/his desire to take a leave of absence at least 30 days before the date the leave is to begin, or as soon as possible.
 
C.        General
1)         Continuation of Benefits
During a leave of absence, Company will maintain an employee's coverage under the Health Plan, provided that the employee pays the premium during the leave period.
 
An employee may choose not to continue coverage. However, if the employee elects not to continue coverage for health, the enrollment provisions for the plans will be used to determine eligibility for coverage when the employee returns from her/his leave of absence.
 
Premium payments must be made on the premium due date each month or they can be prepaid at the employee's option.
 
Arrangements for premium payments must be made through the Company. Company will discontinue health insurance coverage during a leave if the employee's premium payment is more than 30 days late.
 
 
Coordination of Benefits
 
Certain situations (e.g. military) are subject to Federal/State laws and could require planning for coordination with benefit programs.
 
Right to Job Restoration
 
At the conclusion of a leave of absence, an employee will be placed in the same position or in another position if the prior position is not available with the hiring organization.
 
If, during a leave of absence, a layoff or other event occurs that would have changed or eliminated the employee's job had she/he not taken leave, the returning employee will have the same rights as if she/he had not been on leave of absence.
 
Termination
 
If an employee fails to return to work at the expiration of the leave of absence, the employee will be considered to have voluntarily resigned employment.
